Denville Council keeps tree replacement ordinance, but sets limits

DENVILLE TWP. – The Township Council defended and passed a controversial amendment to its tree replenishment ordinance Tuesday, April 16.

The amendment creates a cap that limits tree replacement fees to $35,000 per acre. The council clarified that the cap would rise annually with the cost-of-living rates.

Council members and Fred Semrau, the township attorney, said they created the cap to protect the ordinance from potential lawsuits. The cap will also protect the township from potentially needing to return collected fees because a court considers them excessive.
